AGREEMENT:
In return for the instruction I will receive and for Old Toronto Martial Arts (the “Dojo”) making its facilities and equipment available to me, and in consideration of the payment of the fee set out below, I agree to be governed by the Dojo’s rules and regulation recited in this agreement and as posted in the Dojo from time to time.
Release:
I acknowledge that martial arts training involves physical exertion and risk, and that it is possible that during the course of training or competition, injury may result. I assume full responsibility for any and all damages, injuries, or losses that I may sustain or incur. I also fully and completely RELEASE the Dojo, its employees, officers, directors, students, agents and licensees from any fault or liability relating to any damage, injury or loss of any kind arising directly or indirectly from participation in training competition or the use of the Dojo’s facilities whether cause by the negligence of the Dojo, its employees, officers, directors, instructors, students, agents or licensees, or otherwise. I FURTHER RELEASE the Dojo from any responsibility for the loss, theft or damage to my personal property.
Consent to Treatment:
I authorize the Dojo to secure such medical advice and services as may be deemed necessary for my health and safety. I agree to accept financial responsibility in excess of the benefits allowed by provincial health insurance. I acknowledge that it is my responsibility to obtain periodic medical check-ups and to ensure that I am physically able to participate in training at the Dojo.
If I break the payment schedule, I acknowledge that the balance of my member fee may at the discretion of the Dojo become due and payable in full. Even though I may choose not to use the facilities, I acknowledge That I am responsible for the payment of the full membership fee. I will be fully responsible for any bank charges incurred by the Dojo as a result of there being insufficient funds or dishonoured cheques submitted by me. I also acknowledge and agree that should I break the Dojo’s rules and regulations or any term of this Agreement, the Dojo may cancel any membership without refund.
CONSENT TO BEING FILMED:
I have permitted my participation and/or presence at classes, events or activities related to The Dojo to have been recorded on film and/or videotape. I understand that these photographs and/or video recordings may be used for promotional purposes, including but not limited to social media, websites, brochures, and other marketing materials.
I agree that the recording of my participation may be used or not at the sole discretion of the dojo. If it is used I consent to its use in perpetuity. I understand that the Dojo will own the copyright to the production for which my participation is being recorded and that such production may be exploited in perpetuity throughout the world, in all media including but not limited to television, video, theaters and print.
I expressly release the Dojo and its delegate or assignments from and against any and all claims that I have or may have for invasion of privacy, defamation, copyright or any other cause of action arising out of the filming or videotaping and use of my herein mentioned participation.
In return for my services, the Dojo agrees to include my name in the credits so long as I print it.
